These Terms of Service ("Terms") govern your access to and use of the Teesmith Supplies website at teesmith.com.au (the "Site") and any purchase you make from us. By accessing the Site or placing an order, you agree to these Terms. Please read them carefully.

1. About us

This Site is operated by Teesmith Supplies (ABN 46 284 224 965), based in Sydney, New South Wales, Australia. In these Terms, "we", "us" and "our" refer to Teesmith Supplies, and "you" refers to the person accessing the Site or placing an order.

2. Eligibility

To place an order you must be at least 18 years old and able to enter into a legally binding contract. By ordering, you confirm that you meet these requirements.

3. Products and availability

We make every effort to display our products and their descriptions, colours and details as accurately as possible. Images are for illustration and the actual product may vary slightly. All products are subject to availability, and we may change or discontinue products at any time.

4. Orders

When you place an order, you are making an offer to purchase. Our order confirmation email acknowledges that we have received your order; it confirms receipt, not acceptance. A contract is formed only when we dispatch your order. We may refuse or cancel any order, including where a product is unavailable, where there is an error in pricing or description, or where we reasonably suspect fraud. If we cancel an order you have already paid for, we will refund you in full.

5. Pricing and payment

All prices are listed in Australian Dollars (AUD) and are inclusive of GST where applicable. Prices may change at any time, but changes will not affect orders we have already accepted. Any shipping costs are calculated at checkout. We accept the payment methods shown at checkout, and payment is processed securely by our payment providers; we do not store your full card details.

While we take care to ensure pricing is accurate, errors can occur. If we discover an error in the price of products you have ordered, we will contact you to ask whether you wish to proceed at the correct price or cancel the order.

6. Shipping and delivery

We ship Australia-wide. Delivery timeframes are estimates only and are not guaranteed. Orders are fulfilled through our supplier network. Please see our Shipping Policy for full details. Risk in the products passes to you on delivery.

7. Returns and refunds

Our Return & Refund Policy forms part of these Terms. Please review it before purchasing.

8. Your rights under the Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you are entitled to under the Australian Consumer Law or any other law that cannot lawfully be excluded.

9. Safe use of products and assumption of risk

Our products include golf training aids and sporting accessories. Some involve physical activity, swinging motions, small parts, or equipment that can cause injury or damage if used incorrectly. By using our products you agree to:

use each product only for its intended purpose and in accordance with any instructions provided;
ensure you have adequate clear space, free of people, pets and objects, before using any product that involves a swinging or extending motion;
inspect products before each use and stop using any product that appears damaged or worn;
warm up appropriately, use within your physical capability, and stop immediately if you feel pain or discomfort;
consult a qualified health or coaching professional before use if you have any injury, medical condition or concern;
keep products away from, and supervise their use around, children and bystanders.

To the maximum extent permitted by law, you use our products at your own risk, and we are not liable for any injury, loss or damage arising from incorrect use, misuse, or failure to follow safe-use guidance. Nothing in this section excludes, restricts or modifies any rights or remedies you have under the Australian Consumer Law, including in relation to goods with a safety defect. 10. Limitation of liability

To the maximum extent permitted by law, and subject to your rights under the Australian Consumer Law, we are not liable for any indirect, incidental or consequential loss arising from your use of the Site or any products purchased. Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the goods or paying the cost of resupplying them.

11. Intellectual property

All content on the Site — including text, images, logos, graphics and designs — is owned by or licensed to Teesmith Supplies and is protected by intellectual property laws. You may not copy, reproduce or use our content without our written permission.

12. Acceptable use

You agree not to use the Site for any unlawful purpose, to interfere with its operation or security, or to attempt to gain unauthorised access to any part of it.

13. Privacy

We handle your personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).

14. Third-party links

The Site may contain links to third-party websites. We are not responsible for the content or practices of those websites and provide the links for convenience only.

15. Changes to these Terms

We may update these Terms from time to time. The current version will always be available on this page, with the date of the last update shown above. Your continued use of the Site after any change constitutes acceptance of the updated Terms.

16. Governing law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales.
